Series notes:
This series comprises records of cases heard under the Bankruptcy Act 1870. Documents can include bankruptcy petitions, affidavits by petitioners, declarations admitting liability to pay debts, debtor summons, proof of debts and bills of costs. Some previous petitions for insolvency that had begun just prior to the commencement of the 1870 act were brought under this act and heard.

For records after this date, see holdings of National Archives of Australia per Commonwealth Bankrupcy Act 1924 which commenced on 1 August 1928.

Not all early bankruptcy files have survived and the indexed Minutes of Bankruptcy proceedings can be consulted in these instances (SC34)

System of Arrangement:
Formal numerical registration did not begin until 1877. Prior to this the records are organised chronologically by date petition filed. From 1877 to May 1908, cases have multiple registrations as evidenced in the indexed minutes of the proceedings yet all the paperwork has been kept in one file, as shown by the item level entries.;;;;
